Also If Flynn and his lawyers terminated any direct allegations of incorrect action, they noted that Flynn, unlike other respondents in Mueller’s investigation, was not informed that it was contrary to the law to lie to the FBI. They suggest that the FBI, who approached Flynn at the White House shortly after Trump’s inauguration, played his desire to keep the meeting silent by telling him the fastest way to get the interview done where he was alone with the agents – rather than involving lawyers.
They also insist that Flynn, from Middletown, Rhode Island, deserves credit not to publicly resort to the fact that FBI officials involved in the investigation later came under review themselves. Former deputy chief Andrew McCabe, who contacted Flynn to arrange the interview, was fired this year for what the Justice Department said was lack of joy over a news media leak. Peter Strzok, one of the two agents who interviewed Flynn, was removed from Mueller’s Law, then ripped off to trade anti-Trump texts with another FBI official.
Mueller’s law has sharply pushed back with any suggestion that Flynn was baptized with prosecutors in his own poll on Friday that there was no duty to warn Flynn against lying.
“A seated National Security (advisor), former director of a intelligence agency, retired Director-General and 33-year-old veteran of the Armed Forces knows that he should not lie to federal agents,” accused prosecutors.
Former FBI director James Comey criticized the Brothers on the Flynn investigation during a Monday game at Capitol Hill saying: “They are here attacking the FBI investigation of a guy who pledged to listen to the FBI.”  Trump has not heard that he sees Mueller’s investigation as a “witch hunt” and has continued to lash out on prosecutors, he sees him as a party to him and those who help them. He has shown continued sympathy to Flynn, but calls him a “big person” and claims – wrongly – that the FBI has said he is not lying.
Flynn has not tried to withdraw his guilty regrets, and there is every indication of Arun Rao, a former Attorney General’s prosecutor in Maryland, saying the defense mentality is striking, as it is “inconsistent” with Flyn’s cooperation so far.
“You also wonder in this very unusual situation,” he said, “if it’s a play for forgiveness”.
It is also possible that at least some of the defense’s arguments can resonate with the US District Judge Emmet Sullivan, who led prosecutors to produce FBI records related to Flynn’s interview. It contained parts of Flynn’s February 24, 2017 notes, FBI interview, at the heart of his case.
In response to Sullivan’s orders, prosecutors publicly released an editorial of the FBI interviews late monday evening. The notes show that FBI agents interviewed Flynn about his contacts with Russia, including his previous voyages to the country and his talks with Sergey Kislyak, since Russia’s ambassador to the United States
Last year Flynn allegedly owed the content of his conversation with Kislyak during the presidency.
The notes show that Flynn told reporters that he did not ask Kislyak not to escalate Russia’s response to sanctions imposed by the Obama administration due to constituencies. But Flynn admitted in court records last year that he did.
The notes also show Flynn told agents that he did not ask Kislyak that Russia should vote a certain way against a UN resolution involving Israeli settlements. But in court documents last year, he acknowledged that he asked Kislyak that Russia should vote against or delay the resolution. Legal paper shows that Flynn has made this request in the direction of Trump’s grandson Jared Kushner.
It is unclear what impact, if any notes will have on Sullivan’s judgmental decision.
Sullivan was the judge in the Justice Department’s botched prosecution of now deceased Republican late Ted Stevens in Alaska. He dismissed the case after prosecutors admitted that they kept exculpatory evidence and allowed the referee to say that in nearly 25 years on the bench, “I’ve never seen anything approaching the abuse and misconduct I’ve seen in this case.”  Sullivan said in a statement for The Wall Street Journal last year that the case inspired him to explicitly remind prosecutors in each criminal case before him that he had an obligation to provide positive evidence. He says he has encouraged colleagues to do the same.
But while Sullivan has proven to be particularly sensitive to the hint of the government’s abuse, nothing about the Flynn case comes close, “said Gurule, lawyer professor.
“To portray him as somehow an innocent dup, which in some way only this innocent victim of the process, this suggestion that there was a damn thing – it’s an absurd accusation, he said.
