9659007] Judge Judge Glenn Devlin, a Republican, lost his seat Tuesday to Democratic Opponent Natalia Oakes – in a wave of 59 conservative lawyers who had been ousted by Harris County voters, the NBC Houston affiliate KPRC reported.
And on Wednesday mornings, Devlin had made a decision that shocked Steve Halpert, youth director of the Harris County Public Defender Office.
“The young people were asked if they would if they were released if you were to kill someone,” Halpert told KPRC. “It was a bit shocking because it’s not a question that Judge Devlin would ever ask.” Or any judge. “
The judge’s actions were particularly uneven, considering his record of detained youth defense, according to local media. And even the people charged with helping young men and women fight for their allegations were worried.
“I’m confused by why he did,” Harris County Chief Public Defender Alex Bunin told NBC News on Thursday. ” is definitely not good for the kids in that they are released without any conditions. “
Bunin said he was worried that the children were released on Wednesday claiming that some of them had no parents or guardians to go home at the time of their release and others need support services.
The public defender also said that He is sympathetic to the District Attorney’s concern and says that the referee’s movement can “threaten the public,” according to a statement from Harris County District Attorney Kim Ogg.
“Neither side is happy, Bunin said. “This is different because it is across the board. It has never been done without regard to the effect of the child’s and society’s triggering.”
At least seven children were released, prosecutors declared The Houston Chronicle, including four faced with aggravated robbery charges. Oakes will review cases during a recovery scheduled for January 4, Houston reports.
The ACLU condemned the judge’s actions Wednesday called it “wrongly” and said it was “motivated by the party’s interests” or “the outcome of his political loss.” The organization has since called on the Texas Commission for Judicial Conduct to initiate an investigation.
“Devlins condemns mass emissions of children today, without any apparent concerns about child safety or ensuring that they are released to their parents, proving his release from the needs of each child,” said the ACLU in a statement.
“I mean, the day after the election when he was not re-elected, he changed his policy,” said Bunin. “It does not seem to be an intellectual reasoning rather than making a statement. “
The Texas State Commission on Judicial Conduct told NBC News Thursday that they can not” confirm or deny “the occurrence of a complaint against the judge because of confidentiality rules in the state, according to Eric Vinson, Managing Director of the Commission.
Although Vinson refused to comment on specific facts that meant the event, the director clarified that even an outgoing judge could be investigated.
